Refund, Cancellation & Transfer Policy

This Refund, Cancellation & Transfer Policy governs all participation plans, managed farmland investments, tree ownership allocations, and related services offered by Terrgeum India Pvt. Ltd.
By making any payment or executing any agreement with Terrgeum, the participant agrees to the terms of this policy.
No Cancellation Policy
Participation under any Terrgeum investment plan is final and irrevocable.
Once a payment has been made and the participation has been confirmed, cancellation of the participation shall not be permitted. Accordingly, participants shall not be entitled to claim a refund of the investment amount merely because they choose to discontinue their participation.
Taxes and Commission
In exceptional circumstances where Terrgeum, at its sole discretion, permits termination of a participation, the following amounts shall be **non-refundable** and shall be deducted from any amount, if payable:
* Goods and Services Tax (GST) already collected and remitted to the Government;
* Agent, referral, or channel partner commission already paid;
* Payment gateway charges;
* Banking charges;
* Documentation and administrative expenses; and
* Any other costs incurred by Terrgeum in relation to the participation.
Transfer of Participation
Since cancellation is not permitted, a participant who wishes to exit may request a **transfer of the Participation Agreement** to another eligible person.
Such transfer shall be subject to:
* Prior written approval from Terrgeum;
* Completion of Terrgeum’s verification and compliance process;
* Execution of all required transfer documents;
* Payment of applicable transfer or administrative charges, if any; and
* Compliance with all applicable laws and Terrgeum policies.
Terrgeum shall act as the **sole authorized mediator and administrator** for all transfers of participation rights.
Unauthorised Transfer
Participants shall **not sell, assign, transfer, pledge, or otherwise deal with their participation or allocated trees without the prior written approval of Terrgeum**.
Any transfer, assignment, or arrangement made without Terrgeum’s written approval:
* shall **not be recognized by Terrgeum**;
* shall **not bind Terrgeum** in any manner;
* shall **not entitle the purported transferee to any rights, benefits, payments, or services** from Terrgeum; and
* shall be treated as invalid for all purposes of Terrgeum’s records and administration.
Until a transfer is approved and officially recorded by Terrgeum, **the original participant recorded in Terrgeum’s official records shall continue to be treated as the sole recognized participant for all operational and contractual purposes.**
Recognition of Ownership
Terrgeum shall recognize only the participant whose name appears in its officially maintained records.
No third party shall acquire any ownership rights, revenue rights, harvest rights, voting rights, or other benefits unless the transfer has been:
* approved in writing by Terrgeum; and
* duly recorded in Terrgeum’s official records.
Processing of Transfer Requests
Transfer requests may be approved only after:
* identity verification of both parties;
* completion of KYC and compliance requirements;
* execution of the prescribed transfer documentation;
* settlement of all outstanding dues; and
* payment of applicable transfer charges.
Terrgeum reserves the right to reject any transfer request that does not satisfy its compliance requirements or applicable legal obligations.
Terrgeum's Decision
All decisions regarding transfer requests, verification, compliance, and record updates shall be made by Terrgeum in accordance with applicable law and the Participation Agreement.
